Judgment

ORDER The appellant is the Accused in Crime No.371 of 2026, on the file of the second respondent police. He was arrested in connection with the above case for the offences punishable under Sections 191(2), 140(3), 296(b), 115(2) and 351(2) of BNS and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of SC/ST (POA) Act. He moved bail petition before the learned I Additional District and Sessions Judge (PCR), Tiruchirappalli in Crl.M.P.No.2968 of 2026 and the same was dismissed by the trial Court on 01.08.2026. Challenging the same, the appellant has filed this Criminal Appeal.

¶2The case of the prosecution is that the defacto complainant, who belongs to the Muthuraja community, fell in love with Ajithkumar, who belongs to the Devendrakula Vellalar community. They got married on 25.06.2026 without the consent of their families. As her family opposed the marriage, the couple approached the All Women Police Station, Manapparai, seeking police protection. Later, on 04.07.2026, the couple attended an enquiry at Manapparai Police Station in connection with a complaint given by Murugesan-husband of the complainant's sister. After the enquiry, while they were returning to Sithanatham in an auto-rickshaw, at about 1.40 p.m., near Maravanur Petrol Bunk on the Dindigul-Tiruchirappalli National Highway, two cars intercepted their vehicle. Murugesan, his brother Prakash, the complainant's brother Malaichamy and her younger brother Azhagar forcibly pulled the defacto complainant out of the auto-rickshaw. They threatened her husband, Ajithkumar, abused him in filthy language, uttered caste-based insults and pushed him asided. The defacto complainant was then forced into a Swift Dzire Car, while 3 unidentified persons travelling in an Eeco car restrained Ajithkumar. The Accused took the defacto complainant to a secluded place, threatened her with serious consequences and pressured her to end her relationship with her husband. The defacto complainant managed to escape, reached Manapparai Police Station, and lodged a complaint. Hence the case.

¶3The learned counsel appearing for the appellant submits that now the issue has been amicably settled and the defacto complainant is not having any objection for grant of bail. He further submitted that the co-Accused in this case has already been granted bail by this Court in Crl.A(MD)Nos.881 and 883 of 2026 and this appellant is also similarly placed as that of the other co-Accused.

¶4Accordingly, this Criminal Appeal is allowed and the order passed by the learned I Additional District and Sessions Judge (PCR), Tiruchirappalli made in Crl.M.P.No.2968 of 2026, dated 01.08.2026 is hereby set aside. The appellant is ordered to be released on bail on the following conditions:-

i) The appellant shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned I Additional District and Sessions Judge (PCR), Tiruchirappalli.

ii)The appellant and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Governmnet in proof of their residence address.

iii)The appellant and the sureties shall file an affidavit of undertaking before the respondent police that the appellant and other relative will not disturb the defacto complainant and her husband in future. 14-08-2026 (S.K.,J.) am To
