Judgment

ORDER This petition has been filed seeking relaxation of the bail condition imposed by this Court in Crl.A.(MD) No.594 of 2026, dated 19.06.2026.

¶2The learned counsel for the petitioner submitted that the petitioner was granted bail by this Court, subject to the condition that he shall stay at Madurai and report before the Inspector of Police, Karimedu Police Station, Madurai, every day at 10.30 a.m., except on the hearing dates before the trial Court. Further, the petitioner was directed to file an affidavit before the respondent police stating that he would not misuse the liberty granted to him, would not indulge in any further offence, and would be available for the trial. The learned counsel further submitted that the petitioner has been staying at Madurai and complying with the condition by reporting before the Inspector of Police, Karimedu Police Station, Madurai, for the past 39 days. Since the petitioner is a daily wage, he is unable to pursue his regular avocation due to the said condition. He is also the sole breadwinner of his family. Hence, the learned counsel prayed for relaxation of the said condition.

3.The learned Government Advocate (Crl. Side), appearing for the respondent police, submitted that the petitioner has already filed the affidavit before the respondent police, as directed by this Court. He further submitted that the petitioner has been regularly complying with the said condition for the past 39 days.

4.The learned counsel appearing for the defacto complainant also submitted that he has no objection to the relaxation of the bail condition.

5.The learned counsel for the petitioner further submitted that the petitioner seeks modification of the said condition, particularly in view of the fact that the bail condition imposed on the co-accused has already been relaxed in toto.

6.Considering the above facts and circumstances, this Court is inclined to modify the said condition to the effect that the petitioner shall appear before the Inspector of Police, Karimedu Police Station, Madurai, once a week, i.e., every Monday at 10.30 a.m. Accordingly, the earlier condition imposed by this Court, dated 19.06.2026, is modified to the above extent. The other conditions shall remain unaltered.
