Judgment

O R D E R (Order of the Court was made by M.DHANDAPANI, J.) This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachment made by the fourth and fifth respondents in S.F.No.955/16, situate at Vembakudi, Varavanai village, Kaniyalampatti Post, Kadavur Taluk, Karur District, based upon the petitioner's representation dated 19.09.2023 within the time stipulated by this Court.

¶2By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself. Since no adverse order is going to be passed, notice to the respondents 4 and 5 is dispensed with.

¶3The petitioner claims that the petition-mentioned property was originally owned by his father-in-law, namely, Palaniappan, and is classified as "Natham Poramboke". The fourth and fifth respondents are adjcent land owners. The petitioner alleges that the fourth and fifth respondents have encroached upon the Government property classified as "Sarkar Poramboke" and constructed a building thereon obstructing access to the other property owners. In this regard, the petitioner submitted a representation dated 19.09.2023. However, no orders have been passed on the said representation till date. Hence, the petitioner has approached this Court by way of filing the present writ petition.

¶4The learned counsel further submitted that it would suffice if this Court issues a direction to the respondents 1 to 3 to consider the petitioner's application dated 19.09.2023 and pass appropriate orders thereon within a time frame to be fixed by this Court.

¶5Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the petitioner to submit a fresh representation, along with a copy of this order, to the respondents 1 to 3. Upon receipt of such representation, the respondents 1 to 3 shall consider the same and pass appropriate orders on merits and in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. No costs. [M.D.I.,J.] & [N.D.K.,J.]
