Judgment
ORDER (Order of the Court was made by M.DHANDAPANI.J.) This Writ Petition has been filed for issuance of a Writ of Mandamus directing the respondents 1 to 6 to take necessary action to remove the encroachment and unauthorized construction allegedly made by the seventh respondent in S.No.431/1, situated at Nethaji Nagar, Tirunelveli, and consequently, to consider the representation of the petitioner dated 17.03.2025, within the time stipulated by this Court.
¶2The learned counsel appearing for the petitioner would submit that the petitioner made a representation dated 17.03.2025, complaining of the obstruction caused by the seventh respondent in the public pathway. However, no action has been taken by the respondents. Hence, the petitioner has approached this Court by filing the present Writ Petition.
¶3This Court, by order dated 27.06.2025, directed the Tahsildar to conduct an enquiry with regard to the grievance of the petitioner and file a report before this Court.
¶4Today, the report of the Tahsildar has been placed before this Court. A perusal of the report reveals that an extent of 8 square feet of the land had been occupied/encroached upon. The learned Special Government Pleader appearing for the official respondents would submit that the obstruction, if any, caused by the seventh respondent has already been removed.
¶5In view of the report filed by the Tahsildar and the submission made by the learned Special Government Pleader, nothing further survives for adjudication in the present Writ Petition.
¶6In view of the above, the Writ Petition stands dismissed as infructuous. No costs. Consequently, the connected miscellaneous petition is closed. [M.D.I.,J] [N.D.K.,J]
