Judgment

¶2The case of the prosecution is that on 29.07.2025, at about 04.30 PM, the petitioner along with other accused who belongs to Presidency College assaulted the Pachaiyappa College student with knife who was standing on the Tiruttani Railway Station Platform No.2 along with this friends and he was sustained injuries. Hence the case.

¶3The learned counsel appearing for the petitioner / accused would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he was in judicial custody from 04.11.2025. Hence, he prayed bail for the petitioner.

¶4The learned Government Advocate appearing for the respondent would submit that the investigation is pending and the offences are grave in nature and there is one previous against the accused. Hence he strongly opposed to grant bail to the petitioner.

¶5Heard both sides and perused the materials available on record.

¶6Considering the rival submissions made by the learned counsel on either side, considering the nature of offences and no previous case against the petitioner and considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner, subject to certain conditions. [a] Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Tiruttani, and on further conditions that:- [b] the petitioner shall report before the respondent police on at 10.30 a.m., for a period of thirty days and thereafter as and when required for interrogation. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
