ORDER This Criminal Miscellaneous Petition has been filed by the petitioner, to suspend the sentence imposed by the learned Principal Special Court for Exclusive trial of Cases under POCSO Act, Coimbatore and made in Spl.CC.No.40 of 2020, judgement dated 16.08.2024 and enlarge the petitioner on bail pending disposal of the above Criminal Appeal.
¶2The petitioner herein is the accused in Spl.C.C.No.40/2020 on the file of the Principal Special Court for Exclusive trial of Cases under POCSO Act, Coimbatore, and convicted for the offence under Sections 323 and sentenced to undergo 3 months rigorous imprisonment and under Section 506(i) IPC sentenced to undergo one year rigorous imprisonment and under Section 9(m) r/w 10 of the POCSO Act, and sentenced to undergo 5 years rigorous imprisonment and also directed to pay a fine of Rs.10,000/- in default simple imprisonment for 1 year simple imprisonment. Aggrieved by the same, the petitioner had filed this appeal.
¶3The learned counsel for the petitioner submitted that he was falsely implicated in this case, and he is ready to abide with any conditions.
¶4The learned Government Advocate (Crl.Side) appearing for the respondent raised strong objections to suspend the sentence. He further submitted that at the time of occurrence, the victim girl was 5 years old and the appellant / accused was 65 years old. The appellant had sexually assaulted the minor victim girl.
