Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

06.07.2026 in execution of a Non-Bailable Warrant issued in connection with Crime No.109 of 2025 on the file of the respondent police, seeks bail. Page2 of 6

¶2The case of the prosecution is that the petitioner was originally granted station bail. Due to his non-appearance before the Trial Court, a Non-Bailable Warrant was issued against him, pursuant to which he was secured and remanded on 06.07.2026. Hence, the case.

¶3The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and the absence before the trial Court was neither willful nor intentional. He further submitted that the petitioner strictly undertakes to attend all future trial proceedings without fail and will comply with any stringent conditions imposed by this Court. Hence, he prayed for the grant of bail to the petitioner.

¶4The learned Government Advocate (Criminal Side) appearing for the respondent strongly opposed the grant of bail to the petitioner. He submitted that the petitioner had earlier absconded, which necessitated the issuance of a Non-Bailable Warrant, and he was subsequently secured only on 06.07.2026. He further submitted that if the petitioner is released on bail, he would abscond again, delaying the trial. Hence, he prayed for the dismissal of the bail petition.

¶5Heard the learned counsel for the petitioner as well as the learned Government Advocate (Criminal Side) appearing for the State and perused the materials available on record. Page3 of 6

¶6Considering the facts and circumstances of the case, the period of incarceration undergone by the petitioner from 06.07.2026, and his undertaking to appear before the trial Court regularly, this Court is inclined to grant bail to the petitioner.

¶7Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties, for a like sum to the satisfaction of the Principal District and Sessions Judge, Tiruppur and on further conditions that :- [a] the sureties shall affix his photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure his identity; [b] the petitioner shall report and appear before the trial Court on all working days at 10.30 A.M., until further orders; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforementioned conditions, the Page4 of 6 learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
