Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

21.04.2025 for the alleged offence under Sections 331(4) and 305 of BNS, 2023 in Crime No.93 of 2025 on the file of the respondent police, seeks bail. Page2 of 4

¶2The case of the prosecution is that the petitioner, along with the other accused, committed house-breaking and stolen a 21/2 sovereign gold chain belonging to the defacto complainant. Hence, the case.

¶3The learned counsel for the petitioner submitted that this is the third bail application filed by the petitioner. He further submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner has been in judicial custody since 03.01.2026. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

¶4The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has 22 previous cases, and all cases are similar in nature. He further submitted that the property has not been recovered. Hence, he strongly oppose for the grant of bail to the petitioner.

¶5I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

¶6Considering the submissions of the learned Government Advocate (Criminal Side), it is seen that though the petitioner has 22 previous cases, all of Page3 of 4 them are similar in nature. The learned counsel for the petitioner placed reliance on an order dated 27.07.2026 passed by this Court in Crl.O.P.No.20029 of 2026, contending that the petitioner was granted bail in a similar matter. However, this Court is of the view that the said order cannot be taken into consideration in the present case. Considering the gravity of the allegations, this Court is not inclined to grant bail to the petitioner.

¶7Accordingly, this Criminal Original Petition is dismissed. 20-08-2026 DRL To
