Judgment
O R D E R Mr. P. Siddarth, learned Government Counsel, accepts notice for the first respondent. Mr. Durai Gunasekaran, learned Government Counsel, accepts notice for the second respondent. Since this writ petition can be disposed of without affecting the rights of the third respondent, issuance of notice to the third respondent is dispensed with.
¶2The petitioner is the mother of the third respondent. She states that she had executed a release deed in favour of the third respondent in respect of her immovable property. According to the petitioner, after obtaining the property, the third respondent has failed to provide her with maintenance, basic amenities, physical needs and residence.
¶3Aggrieved by the conduct of the third respondent, the petitioner submitted representations dated 29.06.2026 and 13.07.2026 before the first respondent under Section 23 of the Maintenance and Welfare of Parents and Page Nos.3/6 Senior Citizens Act, 2007, seeking cancellation of the release deed and grant of maintenance.
¶4The grievance of the petitioner is that the said representations have not been considered by the first respondent.
¶5The learned State Counsel, on instructions, submits that the first respondent is not the competent authority to consider such a request. It is submitted that the petitioner ought to have approached the Revenue Divisional Officer, Chengalpattu District, who is the competent authority under the Act to deal with applications under Section 23.
¶6In view of the said submission, this Court is of the opinion that the Revenue Divisional Officer, Chengalpattu District, is a necessary party for the effective adjudication of the matter. Accordingly, the Revenue Divisional Officer, Chengalpattu District, is suo motu impleaded as the fourth respondent in this writ petition. Mr. P. Siddarth, learned Government Counsel, accepts notice on behalf of the newly impleaded fourth respondent.
¶7The Registry is directed to carry out the necessary amendments in the cause title. Page Nos.4/6
¶8The learned State Counsel further submits that if the petitioner submits a fresh application before the fourth respondent, the same will be considered on its own merits and in accordance with law.
¶9Recording the above submission, this writ petition is disposed of by reserving liberty to the petitioner to submit a fresh application under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 before the fourth respondent.
¶10If such an application is filed, the fourth respondent shall issue notice to all the concerned parties, consider the petitioner's claim on its own merits, and pass appropriate orders in accordance with law, within a period of three months from the date of receipt of the application. There shall be no order as to costs.
