¶1The District Registrar, Tamilnadu Co-Operative Society Bank (Urban), Vellore District.

¶2The Secretary, Urban Co-Operative Bank, Pallikonda Anaikattu Taluk, Vellore District. ..Respondents COMMON PRAYER Writ Petitions filed under Article 226 of the Constitution of India, seeking to issue a Writ of Mandamus, directing the 2nd respondent bank to disburse the premium deposits amount of Rs.1,00,000/- to the petitioners based on the petitioners' individual representation dated

12.11.2024. In both cases For Petitioner: Mr.J.Senthil Kumar For Respondents: Mr.R.Chakkaravarthy Government Counsel for R1, Mr.S.Gunasekaran for R2 COMMON ORDER These writ petitions have been filed seeking a direction to the 2nd respondent bank to disburse the premium deposit amounts of Rs.1,00,000/- to __________Page 2 of 4 the petitioners based on the petitioners' individual representation dated

12.11.2024.

¶2The brief case of the petitioners is that the petitioners are the close relatives of one Chitradevi (deceased) who made Fixed Deposits of Rs.1,00,000/- in the 2nd respondent Bank in the year 2017 and appointed them as nominees during her life time. Thereafter she died in the year 2019. It is the grievance of the petitioner that while the petitioners approached the 2nd respondent Bank for disbursal of the Fixed Deposit amount, they claim legal heirship certificate while the petitioners being indicated as nominees in the Fixed Deposit Bonds made by the deceased Chitradevi. Hence, they made representation dated 12.11.2024, requesting the 2nd respondent bank to disburse the said amount in favour of the petitioners. However the same has not been considered yet. Hence, this writ petition.

¶3Heard the learned counsel on either side and perused the materials available on record.

¶4It is not in dispute by the learned counsel for the respondents that deposits of Rs.1,00,000/- were made by the deceased person. However, according to the respondent bank, it is not known as to whom the legal heir of the deceased person to disburse the Fixed Deposit amount. In the event of the __________Page 3 of 4 petitioner producing legal heirship certificate, the 2nd respondent shall act upon it and disburse the respective amounts.

¶5In the case on hand, the petitioners being nominees of the deceased person, they are entitled to the Fixed Deposit amounts. In such an event, if the petitioners are nominees, it is for the respondents to disburse the amount in favour of the nominees irrespective of the nominees being legal heirs or not.

¶6With the above observation, these writ petitions are disposed of. No costs. (K. SURENDER,J.) 15-07-2026 Index: Yes/No Speaking/Non-speaking order vum To
