Judgment
ORDER By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
¶2This writ petition has been filed for a direction, directing the respondents No.2 and 3 for the consolidation and bulk compounding of all pending e-challans.
¶3It is the case of the petitioner that the petitioner is a broker involved in purchasing the second hand vehicle and selling the same to the third party. As a prerequisite for effecting a valid transfer of ownership, the petitioner is required to ensure that all the traffic challans and statutory dues pending against the vehicles intended to be sold are cleared. The petitioner has discovered a larage number of e-challans are pending against various vehicles which have come into the petitioner's inventory. Hence, the petitioner seeks for a direction to the respondents 2 and 3 for the consolidation and bulk compounding of all pending all e-challans.
¶4The learned Government Counsel submitted that whenever the vehicle is involved in violations under the Motor Vehicles Act, penalty will be imposed and unless the penalty is paid, ownership of the vehicle will not be transferred. The penalty has to be paid only by the registered owner and not by a third party. Hence, seeks for dismissal of the writ petition.
¶5Heard both sides and perused the materials placed on record.
¶6At the outset, this Court is unable to comprehend as to how this writ petition is not maintainable. The registered owner who had committed violations under the Motor Vehicles Act ought to have cleared the challans, who is responsible for such violations. The petitioner who is a broker cannot remit such challans on behalf of the registered owners. In such view of the matter, I do not find any merits in this petition.
¶7Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition stands closed. 19-06-2026 dhk Index:Yes/No Speaking/Non-speaking order Internet:Yes To
