ORDER The writ petition is filed for the relief set out below: "the Respondents to pay interest amounts to the petitioners for the belatedly paid service Gratuity, Provident Fund and Leave Salary along with the arrears payable on account of 15 wage Settlement at the rate of 6 percentage per annum for 8 months of delayed payment in the light of the judgement passed by this Court on
23.10.2024 in W.P. No 30766 of 2024 by considering the representation dated 07.04.2026."
¶2It is the case of the petitioner that he was appointed as Conductor in the Respondent Corporation and retired from service on attaining the age of superannuation. After his retirement, the respondents settled his terminal benefits belatedly after eight months, based on last salary paid to them. Therefore, the respondents are legally entitled to pay the interest to the same. While so, the 15th wage settlement was implemented and wage revision was given effect. Therefore, the respondents has to revise the pension, difference in leave salary and gratuity and settle the same.
¶3The petitioner had made a representation to the respondents to pay him the interest for the belated period along with the arrears payable on account of Page3 of 4 implementation of 15th wage settlement with 6% interest. However, the same had not been considered to date by the respondents. Hence, the petitioner is before this Court.
¶4Heard the learned Counsel on either side and perused the records.
¶5Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation dated 07.04.2026 has not been considered to date by the Respondents, a mandamus, is therefore, directing the respondents to pay 6% interest amount to the Petitioner for belatedly paid service Gratuity, Provident Fund and Leave Salary for the delayed period to the petitioner and to pay eligible amount if any, under the 15th wage settlement along with interest at the rate of 6% per annum for the delayed period within a period of six weeks from the date of receipt of a copy of this order.
¶6Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. 05-06-2026 Index: Yes/No Speaking/Non-speaking order ssa Page4 of 4
