PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to disburse the 6 percentage interest for belated payment of Provident Fund, Gratuity, Pension Commutation and Earned Leave Surrender within the stipulated time. In both cases For Petitioner(s): Mr.J.Pradeep For Respondent(s): Mr.K.Raja, Standing Counsel Page3 of 6 COMMON ORDER The writ petitions are filed for the below relief: "directing the respondents to disburse the 6 percentage interest for belated payment of Provident Fund, Gratuity, Pension Commutation and Earned Leave Surrender within the stipulated time ".

¶2The brief facts which has culminated in the filing of these writ petitions are set out below:

2.1. It is the case of the petitioners that they were working in the respective respondent Corporation and retired from service. The respondents settled the petitioners terminal benefits namely Provident Fund, Gratuity, Pension Commutation and Earned Leave Surrender belatedly. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 6% p.a., for the belated payment of the petitioner's Provident Fund, Gratuity, Pension Commutation and Earned Leave Surrender. Since there is no response, the petitioners are before this Court. Page4 of 6

¶3Heard the learned Counsel on either side and perused the materials available on records.

¶4Admittedly, the Provident Fund, Gratuity, Pension Commutation and Earned Leave Surrender has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity, Pension Commutation and Earned Leave Surrender within a period of one (1) month from the date of receipt of a copy of this order.
