Judgment

ORDER This criminal original petition has been filed to call for the entire records pertaining to Crime No.1326/2021 dated on 20.11.2021 on the file of the 1st respondent police and quash the same. Page2 of 4

2.The gist of the case is that on 20.11.2021, when Mr.Ragukumar, police officer along with Thirumurugan police personnel was on day patrol duty in the Mambakkem SIPCOT and Araneri areas, they noticed posters announcing a protest against the President of Palnellur Panchayat. Thereafter, while proceeding towards Palnellur, at about 5.00 p.m. they found one Solomon, S/o. Munusamy, State Organising Committeee Member of Ambedkar Pothuvudamai Munnani, Narasingapuram, pasting the said posters in front of YAMAHA Company, Palnellur. When questioned as to why he was pasting posters without permission, Solomon abused the police personnel in filthy language and threatened them with dire consequence. He also obstructed them from discharging their official duties. Hence, lodged a complaint.

3.The learned counsel for the petitioner submitted that FIR is clear abuse of process of law and has been registered with an influence of the Panchayat Head due to personal motive to harass the petitioner. Further, he submitted that the posters were pasted only to announce a peaceful democratic protest, which does not constitute the offence. The respondent police have falsely implicated the petitioner. Hence, he prayed to quash the FIR in crime No.1326 of 2021. Page3 of 4

4.The learned Government Advocate (Crl.side) appearing for the first respondent submitted that during the patrol duty, the respondent police found petitioner pasting protest posters without permission. When questioned, the petitioner abused the respondent police in filthy language. Hence, he object to quash the criminal proceedings.

¶5Considering the rival submission and on perusal of the materials available on record, it is seen that the allegation against the petitioner is pasting the protest posters and there is no material to show obstruction of official duty. Hence, continuation of criminal proceedings would amount to abuse of process of law. In view of the same, this Court is inclined to allow the criminal original petition. Accordingly, the criminal original petition is allowed. 03-06-2026 Index: Yes/No Speaking/Non-speaking order sms To
