Judgment
ORDER The petitioner claims to have purchased two parcels of land in Survey No.266/1, measuring 0.81.00 ares, and Survey No.266/4, measuring 0.81.00 ares, situated at A.Sathanur Village, Ulundurpet Taluk, Kallakurichi District, for the purpose of establishing an industrial unit.
¶2The petitioner states that two industries are already functioning in the said village. He further claims that a designated industrial area exists in A.Sathanur Village. According to the petitioner, some residents are attempting to put up residential constructions in the said area. Therefore, he submitted a representation to the authorities seeking a direction to prevent the construction of Page4 of 6 residential buildings and the formation of residential layouts in the alleged industrial area.
¶3The 5th respondent has filed a counter affidavit stating that there is no designated residential or industrial zone in Kallakurichi District, as claimed by the petitioner. It is further stated that Kallakurichi District is a non-planning area and that there is no record in the office of the 5th respondent to show that planning permission was granted to the petitioner for establishing an industrial unit.
¶4In the absence of any restriction on the use of the land for residential purposes, the petitioner's contention that the land cannot be used for residential purposes cannot be accepted. Further, the 5th respondent has categorically stated that Kallakurichi District is a non-planning area and that no Master Plan is in force as of now. The petitioner, therefore, has no statutory right to seek a direction to the respondents to consider his representation.
¶5In view of the above, the writ petition is dismissed. Consequently, the connected Miscellaneous Petitions, including the petition seeking impleadment, are also dismissed. There shall be no order as to costs. 19-08-2026 Index: Yes/No Speaking/Non-speaking order ssk To
