ORDER This Civil Revision Petition has been filed challenging the order passed by the Trial Court, allowing the application filed by the first respondent herein seeking to implead himself as party/28th defendant.
¶2The father of the plaintiffs 2 and 3 and first respondent herein, namely V.V.Shanmugam filed a suit in O.S.No.216 of 2008 seeking declaration of title and recovery of possession and also for mandatory injunction to remove the construction found in the suit property. Pending suit, the said V.V.Shanmugam died. The petitioner herein, namely V.S.Ravi and the 2nd respondent herein, namely V.V.Mohan, who are the sons of the sole plaintiff, filed an application to get themselves impleaded as legal heirs of the deceased V.V.Shanmugam and the said application was allowed and consequently, they were impleaded as plaintiffs 2 and 3. Thereafter, the first respondent/proposed 28th defendant, who is also a son of the sole deceased plaintiff, filed the instant application seeking impleadment as one of the parties/defendants. The said application was allowed by the Trial Court. Aggrieved by the same, the petitioner/2nd plaintiff has filed the present civil revision petition.
¶3The learned counsel for the petitioner would submit that the first respondent is the legal heir of the deceased sole defendant and if he is Page5 of 7 impleaded as one of the parties/defendants, the rights of the petitioner and the 2nd respondent/plaintiffs 2 and 3 would get prejudiced.
¶4It is not disputed that the first respondent is also one of the legal heirs of the deceased sole plaintiff, namely V.V.Shanmugam and therefore, he is entitled to represent the estate of the deceased. Some reasons or other, the first respondent is not willing to join with the petitioner and the 2nd respondent as a party plaintiff in the suit. However, as the legal heir of the deceased plaintiff, he is entitled to come on record in the suit. The first respondent, as a representative of the estate of the deceased is entitled to participate in the legal proceedings and he is a proper party to the suit proceedings. Therefore, the Trial Court rightly impleaded the first respondent as a party defendant and the said order does not suffer with any irregularity or illegality.
¶5Accordingly, this civil revision petition is dismissed. There shall be no order as to costs. Connected miscellaneous petition is closed. 13-02-2026 Index: Yes/No Speaking/Non-speaking order MST Page6 of 7
