ORDER Date : 25-07-2023 Heard Mr. C. Modi, learned counsel for the petitioner. Also heard Ms. K. Wangmo, learned Junior Government Advocate representing the State respondents.
¶2This writ petition is directed against the order dated 13.07.2023, passed by the Principal Chief Conservator of Forests (Environment, Forest & Climate Change), Govt. of Arunachal Pradesh, vide No. FOR. 187/EA/EA/2022/(SFS) / 20358 - 90, whereby, the petitioner, who has been working as a District Forest Officer (DFO), Nampong Forests Division, Jairampur, for the past 4
(four) years has been transferred and posted as DFO Southern Resource Survey Division, Deomali, contending that the petitioner will be retiring from service on 28.02.2021 and no employee who is on the verge of retirement should be transferred.
¶3Though the petitioner has put to challenge the aforesaid order of transfer, dated 13.07.2023, whereby, he has been transferred and posted as DFO Southern Resource Survey Division, Deomali, yet the petitioner has submitted a representation to the Principal Chief Conservator of Forests (Environment, Forest & Climate Change), Govt. of Arunachal Pradesh, dated
14.07.2023, whereby, he has made an appeal for posting him in the Office of Chief Conservator of Forest, Southern Circle, Deomali with additional charge of DFO, SRS Division, Deomali. From the aforesaid representation dated
14.07.2023, it appears that the petitioner would like to be posted in the Page No.# 3/3 Office of the Office of Chief Conservator of Forest, Southern Circle, Deomali with additional charge of DFO, SRS Division, Deomali. Vide the impugned order of transfer dated 13.07.2023, the petitioner has already been posted as DFO Southern Resource Survey Division, Deomali. Thus, though the petitioner has put to challenge the impugned order of transfer dated
13.07.2023, whereby, he has been transferred from Jairampur to Deomali, the petitioner appears to be not averse to him being transferred at Deomali.
¶4The only wish of the petitioner appears to be that he would like to be posted in the Office of the Chief Conservator of Forest, Southern Circle, Deomali with additional charge of DFO, SRS Division, Deomali, as indicated in the representation, dated 14.07.2023, submitted to the Principal Chief Conservator of Forests (Environment, Forest & Climate Change), Govt. of Arunachal Pradesh by him.
¶5In that view of the matter, this writ petition is disposed of with a direction to the Principal Chief Conservator of Forests (Environment, Forest & Climate Change), Govt. of Arunachal Pradesh, to consider and dispose of the representation submitted by the petitioner, dated 14.07.2023, on its own merit, within 2 (two) weeks from the date of receipt of the certified copy of this order.
¶6The writ petition stands disposed of, in terms above. JUDGE Comparing Assistant
