ORDER Date : 21.08.2023 (Nelson Sailo, J) Mr. M. Batt, learned counsel appears for the applicant and submits that by filing this application, the applicant seeks permission from this Court to file a third party appeal against the Judgment dated 22.07.2022 passed by the learned Single Judge in WP(C) No. 291(AP)/2019. The learned counsel submits that the applicant is affected by the direction passed by the learned Single Judge but he was not made a party in the writ proceedings. As such, he submits that the applicant may be permitted to file a third party appeal. Page No.# 4/4 Mr. A. Apang, learned Senior Counsel and Standing Counsel APPSC submits that he has no objection to the application. It is further seen that although the respondent No. 5 who was represented by Mr. Ahmed, learned counsel for the respondent No. 5 was given an opportunity to file objection to the application but objection has not been filed till date. Moreover, the respondent No. 5 is also not represented today. Be that as it may, having regard to the submissions made in the application, we deem it fit and proper that the application should be allowed in view of the fact that the applicant appears to be affected by the impugned Judgment as referred to herein above while he was not made a party to the writ proceeding. The application for permission to file a third party appeal is therefore allowed. I.A stands disposed of.
