Heard Mr. S. Tapin, learned Senior Government Advocate for the applicant, for State of Arunachal Pradesh and Mr. M. Kato, learned DSGI for opposite party No. 125.

This is an application under Section 5 of the Indian limitation Act 1963, for condoning the delay of 45 days in preferring the WA/06(AP)/2023, whereby, the order dated 16.12.2022 passed by the learned Single Judge in IA(C)/248(AP)/2022 has been put to challenge.

Having perused the order dated 16.12.2022 passed in I.A(C)/248(AP)/2022 by the learned Single Judge and to the extent the said order has been put to challenge in WA/06(AP)/2023, we are of the view that even if the writ appeal is allowed the opposite parties No. 1 to 124 herein would Page No.# 49/49 not be prejudiced in any manner.

In view of the above this application filed under Section 5 of the Limitation Act, 1963 is taken up for adjudication, without issuing notice to the opposite parties No. 1 to 124.

Having heard the learned counsels for the parties and on perusal of the reasons assigned in the accompanying application, stating that the delay of 45 days in preferring the writ appeal has occurred in seeking approval of the Director of Land Management, Itanagar, for preferring the related writ appeal, we are satisfied that there was no laches or negligence on the part of the applicant and the applicant was prevented by a sufficient cause in not preferring WA/06(AP)/2023 within the stipulated time.

In view of the above, the delay of 45 days in preferring the WA/06(AP)/2023 by the applicant is hereby condoned in the interest of justice.

The Interlocutory application stands allowed and disposed of.
