Judgment

ORDER Date : 19.12.2023 Heard Mr. M.P. Choudhury, learned counsel for the applicant; Mr. J. Chutia, learned Standing Counsel, Karbi Anglong Autonomous Council [KAAC]; Mr. R.K. Talukdar, learned Standing Counsel, NHIDCL; and Mr. S. Baruah, learned Junior Government Advocate, Assam for the state respondents.

¶2The applicant as the writ petitioner, has preferred the connected writ petition, W.P.[C] no. 6620/2023 to assail an order dated 21.06.2023 passed by the Joint Secretary, Department of Revenue, KAAC & Competent Authority for Land Acquisition [CALA].

¶3The instant interlocutory application has been preferred by the applicant-writ petitioner seeking amendment/correction in the Cause-Title in the connected writ petition in so far as the particulars pertaining to the party-respondent no. 1 and party-respondent no. 5 in the array of respondents are concerned.

¶4It has been averred that due to inadvertent typographical errors, the Page No.# 4/5 particulars of the party-respondent no. 1 have been shown as 'The State of Assam, represented by the Principal Secretary to the Government of Assam, Karbi Anglong Autonomous Council, Diphu – 782460, Karbi Anglong, Assam' instead of 'The State of Assam, represented by the Principal Secretary to the Government of Assam, Revenue and Disaster Management Department, Assam Secretariat, Dispur, Guwahati – 781006'.

¶5Similarly, the particulars of the party-respondent no. 5 have been reflected as 'The Ministry of Road Transport and Highways, represented by the General Manager, National Highways and Infrastructure Development Corporation Ltd. [NHIDCL], Diphu – 782460, Karbi Anglong, Assam' instead of 'The General Manager, National Highways and Infrastructure Development Corporation Ltd. [NHIDCL], Diphu – 782460, Karbi Anglong, Assam'.

¶6It is submitted on behalf of the applicant-writ petitioner that such corrections are required for effective adjudication of the connected writ petition.

¶7The prayer for amendment/correction in the Cause-Title in the connected writ petition has not been objected to by the learned counsel appearing for the opposite parties.

¶8I have gone through the statements and averments made in this interlocutory application and it appears that the mistakes crept in the connected writ petition appears to be inadvertent ones. For effective adjudication of the issues involved in the connected writ petition, such amendment/correction as regards the party-respondent no. 1 and party-respondent no. 5 appear necessary. Accordingly, the instant interlocutory application has been allowed.

¶9The office to cause necessary correction in the Cause-Title of the Page No.# 5/5 connected writ petition in so far as the party-respondent no. 1 and the party-respondent no. 5 are concerned in the manner indicated above. For facilitating such amendment/correction, the learned counsel for the applicant-writ petitioner shall file an amended Cause-Title in terms of the Notification no. 79 dated 19.06.2023 by tomorrow i.e. 20.12.2023.

¶10Thereafter, list the connected writ petition immediately after the ensuing winter vacation in the motion column.
