09.11.2011 The present petition has been filed under Section 560 of the Companies Act, 1956 for restoration of petiti oner-company. Mr. K.S. Pradhan, Deputy Registrar of Companies appearing for respondent states that he has no objection to the name of the petitioner-company being restored provided petitioner-company files pending statutory returns, i.e., Annual Returns from 1994 to 2005 and 2008 to 2010, Balance Sheets as at 1994 to 2005 and 2008 to 2010 and 'No Objection Certificate' from directors and shareholders with an undertaking for enhancement of paid up capital by filing of return of allotment of shares with effect from 13th December, 2000 and pays fee and additional fee as applicable as on the date 2-Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. Keeping in view the fact that the Annual Returns and Balance Sheets have not been filed by the petitioner-company for a long period, Mr. Manoj Kumar Garg, learned counsel for petitioner-company himself states that petitioner-company would pay additional costs of Rs. 1,00,000/- to respondent. • Accordingly, upon payment of costs of Rs. 1,00,000/- within a period of three weeks, the name of the petitioner-company shall stand restored and its status would be changed from inactive to active company. Petitioner-company is granted four weeks' time to file no objection certificates from other directors and shareholders as well as statutory documents like Annual Returns from .1994 to 2005 and 2008 to 2010, Balance Sheets as at 1994 to 2005 and 2008 to 2010 along with the prescribed fees in accordance with law and 'No Objection Certificate' from directors and shareholders with an undertaking for enhancement of paid up capital by filing of return of allotment of shares with effect from 13th December, 2000.
