ORDER
09.11.2011 By this petition, the Petitioner seeks parole on the ground that he has to search a suitable match for himself and to re-establish social ties. By Miscellaneous Application No. 10006/2011 the Petitioner has also filed certain additional grounds stating that he has faced a long incarceration and wants to look after ancestral property. On a notice being issued, a status report has been filed. As per the status report, the Petitioner and his brother have been in Tihar Jail since the date of arrest. Their father had expired during their childhood and the mother expired five years back. The jhuggi of the Petitioner was damaged by the flood of the Sharda River and thus the plot is lying vacant. There is no other relative of the Petitioner. On this verification, the learned counsel for the Petitioner was asked to take instructions from the Petitioner. In the meantime, a further status report has been filed by the State stating that there is no encroachment on the land of the Petitioner. In the facts and circumstances of the case, since the Petitioner has not been released either on parole or bail for the last 12llz years, I deem it to be a fit case to grant parole to the Petitioner. It is, therefore, directed that the Petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of Rs.25,000/- with two sureties of the like amount subject to the satisfaction of the learned Trial Court/CMM. Petition and application are disposed of. Copy of this order be communicated to the Petitioner through Superintendent, Tihar Jail.
