08.11.2011 By this petition, the Petitioner seeks parole on the ground that he has to file Special Leave Petition before the Hon'ble Supreme Court and to re establish social ties. On a notice being issued to the State, a status report has been filed. As per the status report, the family of the Petitioner comprises of his widow mother and a younger brother aged about 22 years. The Petitioner has four married sisters. Further, the house of the Petitioner's mother is a four story house where the family is residing on the ground floor and three floors of the said house have been given on rent. Orally, it is also stated by the learned counsel for the State that the said property has been mortgaged. p I' In view of the fact that the Petitioner has been in continuous custody since P' December, 2004 and has undergone almost IV2 years of imprisonment including the remission, I deem it to be a fit case to grant parole. It is therefore directed that the Petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of Rs.25,000/- with two sureties of the like amount subject to the satisfaction of \ ' the learned Trial Court/CMM. It is clarified that one of the surety would be a family member of the Petitioner. Petition is disposed of. Copy of this order be communicated to the Petitioner through Superintendent, Tihar Jail.
