25.08.2026 CM 199/2026 (exemption) Exemption granted, subject to just exceptions. Let requisite compliances be made within 01 week. The application stands disposed of. W.P.(C)-IPD 35/2026 By way of the present petition filed under Articles 226 and 227 of the Constitution of India, the petitioner seeks restoration of the petitioner's Opposition bearing No.1179106 to the trademark application filed by respondent No.2, which it is claimed, has been allowed while the petitioner's opposition was still pending. Issue notice. This is a digitally signed order. W.P.(C)-IPD 35/2026 Ms. Vanshika Arora, learned counsel appears on behalf of respondent No.2 on advance copy; accepts notice; and submits that they have no objection to the prayer in the petition being allowed, namely that the petitioner's opposition be considered before the Registrar takes a decision on the registration of respondent No.2's trademark. Though no one is present on behalf of respondent No.1/Registrar of Trade Marks, in view of the stand taken by respondent No.2, the logical sequitur is that the registration of respondent No.2's trademark vide registration No.5345163 is set-aside; and the matter is remanded for respondent No.1 to reconsider respondent No.2 application for registration of trademark. The petition is disposed-of in the above terms. Pending applications, if any, also stand disposed-of. A. J. BHAMBHANI, J AUGUST 25, 2026/ak At 01:30 p.m. At this stage, Ms. Nidhi Raman, learned CGSC has appeared on behalf of respondent No.1/The Registrar of Trade Marks; and has been apprised of the order passed.
