Case no.
CRL.M.C. 6273/2026

Judgment

J U D G M E N T (oral)

¶1Petitioner seeks quashing of FIR No. 2148/2015, registered at Police Station Mangol Puri, for commission of offences under Sections 354D/509 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

¶2Aforesaid FIR has been registered on the basis of complaint lodged by respondent No. 2 herein, who informed the police that she was being harassed by some unknown person who was making repeated calls to her on her mobile phone and was using objectionable words. On the basis of investigation carried out, police was able to reach the alleged offender i.e. petitioner herein.

¶3Charges have already been framed and the case is at the stage of

prosecution evidence.

¶4Complainant i.e. respondent No. 2 herein has entered into witness-box, albeit, examined in part as she is yet to be cross-examined.

¶5In the interregnum, both the parties have reached an amicable settlement and compromised the matter under the aegis of Delhi Mediation Centre, Rohini District Courts, Delhi.

¶6Respondent No. has joined the proceedings through videoconferencing and she has also been duly identified by her counsel who has also joined the proceedings through videoconferencing. IO is also present and she also identifies respondent No. 2.

¶7Respondent No. 2, when asked, submitted that she has settled the matter with the petitioner. She submits that petitioner is remorseful for his act and conduct and has assured not to repeat any such thing in future and keeping in mind the overall facts and his apology, she has already forgiven him, without any monetary consideration. She submits that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever and therefore, she would have 'no objection' if FIR in question is quashed.

¶8In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose. In any case, even the complainant does not wish to press any charges against the petitioner.

¶9Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR.

¶10Consequently, to secure the ends of justice, FIR No. 2148/2015, registered at Police Station Mangol Puri, for commission of offences under Sections 354D/509 IPC, along with all consequential proceedings arising

therefrom, is quashed.

¶11Original affidavits of the parties, copies of which have been filed with the present petition, shall be submitted before the learned Trial Court within four weeks from today so that these become part of Trial Court Record.

¶12The petition stands disposed of in aforesaid terms.

¶13Pending application also stands disposed of.
