¶3By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS'), the petitioners seek quashing of FIR No. 08/2020, registered at Police Station New Delhi Railway Station, Delhi, for the offences punishable under Sections 279 and 337 of the Indian Penal Code, 1860 (hereinafter referred to as the 'IPC'), as well as Sections 468 and 471 of the IPC and Sections 146 and 196 of the Motor Vehicles Act, 1988, which were subsequently added, and all consequential proceedings emanating therefrom. ¶4Issue notice. The learned APP accepts notice on behalf of the State.
¶5The petitioners and Respondent No. 2 are present before this Court and have been duly identified by the Investigating Officer concerned and their respective learned counsel.
¶6Brief facts of the case are that the present FIR came to be registered pursuant to an incident dated 06.02.2020 at about 8:30 a.m. near Gate No. 2 of New Delhi Railway Station, wherein the vehicle bearing registration No. DL-1T-8018, allegedly being driven by Petitioner No. 1, came into contact with Respondent No. 2, resulting in injuries to her. The FIR was registered under Sections 279 and 337 of the IPC. During the course of investigation, allegations relating to an invalid/fake insurance policy were also made against Petitioner No. 2, pursuant to which Sections 468 and 471 of the IPC and Sections 146 and 196 of the Motor Vehicles Act, 1988 were subsequently added.
¶7Learned counsel for the petitioners submits that the incident was accidental in nature and that immediately after the accident, Petitioner No. 1 took Respondent No. 2 to the hospital and extended all possible assistance to her. It is further submitted that the parties have amicably resolved their disputes and that a Settlement Agreement dated 03.03.2020 was executed between them, pursuant to which the petitioners paid a sum of Rs. 50,000/- to Respondent No. 2 towards full and final settlement. It is also submitted that the settlement was subsequently recorded before the learned MACT Court vide Settlement Award dated 14.10.2020.
¶8Learned counsel for the petitioners further submits that the insurance policy in question had been obtained through a third-party agent and that the petitioners had no intention to use any false or fabricated document. It is The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. submitted that the petitioners have already compensated Respondent No. 2 and that nothing survives between the parties.
¶9On a query made by this Court, Respondent No. 2, who is present before the Court and has been duly identified by the Investigating Officer and her learned counsel, states that she has entered into the settlement voluntarily, out of her own free will and without any pressure, coercion or undue influence. She further states that she has received the settlement amount and has no objection if the present FIR, charge-sheet and all consequential proceedings emanating therefrom are quashed.
¶10Learned APP for the State submits that, in addition to the offences under Sections 279 and 337 of the IPC, Sections 468 and 471 of the IPC and Sections 146 and 196 of the Motor Vehicles Act, 1988 have also been added in the charge-sheet in relation to the insurance policy. It is submitted that the vehicle did not have valid insurance at the relevant time and that a subsequent insurance policy was furnished, which was found to be fake/not traceable in the records of the concerned insurance company.
¶11This Court has considered the submissions made by the learned counsel for the parties and the learned APP for the State. The dispute between the petitioners and Respondent No. 2 has been amicably resolved and Respondent No. 2, being the injured person, has voluntarily consented to the quashing of the proceedings. The settlement between the parties has also been recorded before the learned MACT Court.
¶12In view of the settlement arrived at between the parties, and considering the nature and circumstances of the dispute, continuation of the criminal proceedings arising out of the accident would serve no useful purpose so far as the dispute between the petitioners and Respondent No. 2 is concerned. The The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. parties have resolved their disputes and Respondent No. 2 does not wish to pursue the matter any further.
¶13Accordingly, FIR No. 08/2020, registered at Police Station New Delhi Railway Station, Delhi, for the offences punishable under Sections 279 and 337 of the IPC, as well as Sections 468 and 471 of the IPC and Sections 146 and 196 of the Motor Vehicles Act, 1988, along with the charge-sheet and all consequential proceedings emanating therefrom are hereby quashed.
¶14The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of.
