20.08.2026
¶1Heard learned Senior Counsel for the Appellants.
¶2The order under challenge is dated 17.07.2026 ("Impugned Order") passed by learned Single Judge wherein certain tentative observations have been made, however, the matter has yet to be heard finally.
¶3We further note that no direction has been issued by the learned Single Judge by passing the Impugned Order. The only concern of the learned Senior Counsel for the Appellant is that the observations made in the Impugned Order may not be treated to be final. We are unable to agree with the submissions made by learned Senior Counsel for the Appellant for the sole reason that the observations made in the Impugned Order are only tentative. This is a digitally signed order. 4. The matter is yet to be finally decided where the Appellant will have ample opportunity to put forth its case. Accordingly, we are not inclined to entertain this Appeal.
¶5The Appeal is hereby dismissed. DEVENDRA KUMAR UPADHYAYA, CJ TEJAS KARIA, J AUGUST 20, 2026/ 'A' This is a digitally signed order.
