ORDER (Order of the Court was made by S.M.Subramaniam J.) Writ of Mandamus has been instituted to direct the respondents to remove the encroachments.

¶2Learned Additional Government Pleader appearing on behalf of the HR&CE Department would submit that survey of temple properties will be conducted by the competent authority and eviction proceedings will be enquired by invoking Section 78 of the HR & CE Act. It is needless to state the Page5 of 7 temple properties are to be protected in the manner contemplated under the Act and Rules.

¶3The petitioner has raised several grievance in the matter of protection of temple properties. He has furnished all the details regarding the encroachments. That being the factum, the official respondents are directed to conducted inspection and identify the encroachments in the temple properties and thereafter, initiate eviction proceedings under section 78 of the HR&CE Act. Such exercise is directed to be initiated within a period of twelve weeks from the date of receipt of a copy of this order and the action initiated must be continued until eviction proceedings are completed and the properties belong to the temple are resumed and utilised for the benefits of the temple under the provisions of the Act.
