JUDGMENT AND ORDER (ORAL)
¶1The writ petitioners who are the Dorbar of Nongkhlaw Syiemship represented by the Syiem, and the Dorbar Shnong of Mawlangren represented by the Sordar, have filed the instant writ petition with a prayer to direct the respondents Nos. 1 & 2, to dispose of the representation dated 16.04.2024, and further to direct the respondent No. 2, not to hinder the further construction of the Eklavya Model Residential School, as it involves a public project and infrastructure, which is for the interest of the residents of the petitioners' Village.
¶2On appearance of the parties, the matter had progressed and as the issue was with regard to the construction of the School at Mawlangren, where there were claims and counter claims of ownership over the land, the same was sought to be settled out of Court. However, in view of the pending dispute, the construction of the School had been stalled.
¶3Today, the parties submit that while the settlement talks are still on, the School construction will not be hindered by either party. In this regard, an NOC, as also a representation has been given by the respondent No. 6, to this effect.
¶4Mr. A.R. Passah, learned counsel for the petitioners submits that as the subject matter in issue in the writ petition is only with regard to the construction of the School, nothing remains for consideration in the instant writ petition, and whatever claims and counter claims the parties have, are being adjudicated before the Trial Court, in a pending Title Suit between the parties.
¶5In this view of the matter, as the writ petition has been rendered infructuous, the same accordingly stands closed and is disposed of. Chief Justice (Acting) Meghalaya
