JUDGMENT AND ORDER (ORAL)

¶1The writ petitioner before this Court is the wife of one Late Emmanuel Arengh, who was initially appointed as Store Keeper in the office of the Assistant Agriculture Engineer (Mech), East Garo Hills District on 27-02-1997. The writ petitioner's husband who was still in service expired on 25-08-2020, but however, on the claim of the writ petitioner to the family pension and other terminal benefits of her deceased husband, it was indicated vide a communication dated 02-03-2023 that the proposal for regularization of the service of the retired incumbent had been forwarded vide a letter dated 10-04-2013, and the services were yet to be regularized.

¶2Mr. P. T.Sangma, learned counsel for the petitioner submits that the writ petitioner's husband in fact is similarly placed with a set of other employees for which the proposal for regularization of the adhoc service is still under examination. A copy of a letter dated 11th October, 2023, showing this fact has been produced wherein it is seen that the name of the Late husband of the petitioner is at Sl. No. 24. He further submits that this Court in WP(C). No. 42 of 2024, by an order dated 25-06-2024, on the same circumstances had directed the respondents concerned to expedite the consideration for regularization. He prays that the same consideration be allowed to the writ petitioner's late husband.

¶3Ms. N.G.Shylla, learned Sr. GA on behalf of the State respondents has submitted it is not that the petitioner in the other writ petition, or the deceased husband of the writ petitioner in this writ petition, are entitled to regularization automatically, but the same is subject to examination as to whether they are eligible for the same.

¶4Accordingly, in view of the submissions, it is directed that as the proposal for regularization of the adhoc service of the writ petitioner's late husband is under consideration, it is expected that the same be completed expeditiously within a period of three months from today.

¶5Writ petition accordingly stands closed and disposed of. Chief Justice (Acting) Date: 2024.09.09 17:40:47 IST
