Judgment

Court No. - 2 Case :- WRIT - C No. - 10866 of 2024 Petitioner :- Punam Singh Respondent :- State Of U.P. Thru. Chief Secy. Govt. Lko. And 6 Others Counsel for Petitioner :- Awanish Kumar Bhatt,Siddhartha Sharma Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy, J. Hon'ble Brij Raj Singh, J.

¶1Heard learned counsel for the petitioner, learned Standing Counsel for State-opposite parties no.1 to 4.

¶2Considering the order proposed to be passed, issuance of notice to opposite parties no.5 to 7 is dispensed with.

¶3The petitioner alleges acquisition of a gata bearing No.465 situated at Village Gangauli, Pargana Sikandarpur Sarosi, Tehsil and District Unnao. The petitioner claims rights and interest in the said gata, which as per the khatauni, a copy of which is annexed as Annexure-3, is presently recorded in the name of opposite party no.5. The petitioner claims to have initiated some civil proceedings before the Civil Judge (Senior Division), South, Unnao bearing Regular Suit No.1028 of 2023 (Punam Singh Vs. Smt. Rajeshwari and 3 others). Moreover, we find that a notice has been issued by the competent authority under the National Highways Act, 1956 asking the petitioner to appear before him on 5.12.2024 with relevant documents of title etc. and place her version. As the competent authority is already seized with the matter and there is an entire mechanism under the National Highways Act, 1956 in this regard, the petition is not maintainable at this stage.

¶4Writ petition is disposed of with liberty to the petitioner to pursue other remedies. . (Brij Raj Singh, J.) (Rajan Roy, J.) Order Date :- 19.12.2024/Rao/- High Court of Judicature at Allahabad, Lucknow Bench
