Income-tax Act, 1961 · Chapter II: Basis of Charge

Section 5: Scope of total income

The Income-tax Act, 1961 was repealed by the Income-tax Act, 2025 from 1 April 2026. The text is kept here because the judgments below apply it.

In plain words

This section sets the scope of total income, which depends on whether the person is resident, not ordinarily resident or non resident.

  • A resident is taxed on income received in India, income that accrues or arises in India, and income that accrues or arises outside India.
  • A person not ordinarily resident is not taxed on income accruing outside India, unless it comes from a business controlled in or a profession set up in India.
  • A non resident is taxed only on income received in India or accruing or arising in India.
  • Income is not treated as received in India just because it appears in a balance sheet prepared in India.
  • Income taxed once on an accrual basis is not taxed again when received.

(b) accrues or arises or is deemed to accrue or arise to him in India during such year; or

(c) accrues or arises to him outside India during such year:

Provided that, in the case of a person not ordinarily resident in India within the meaning of sub-section (6) of section 6, the income which accrues or arises to him outside India shall not be so included unless it is derived from a business controlled in or a profession set up in India.

(2) Subject to the provisions of this Act, the total income of any previous year of a person who is a non-resident includes all income from whatever source derived which—

(b) accrues or arises or is deemed to accrue or arise to him in India during such year.

Explanation 2.—For the removal of doubts, it is hereby declared that income which has been included in the total income of a person on the basis that it has accrued or arisen or is deemed to have accrued or arisen to him shall not again be so included on the basis that it is received or deemed to be received by him in India. 4. The words —or previous years, as the case may be‖ omitted by s. 5, ibid. (w.e.f. 1-4-1989).
