Income-tax Act, 1961 · Chapter XX: Appeals and Revision · A.—Appleas to the Deputy Commissioner (Appeals) and commissioner (Appeals)
Section 251: Powers of the Commissioner (Appeals)
The Income-tax Act, 1961 was repealed by the Income-tax Act, 2025 from 1 April 2026. The text is kept here because the judgments below apply it.
In plain words
This section defines the powers of the Commissioner (Appeals) when handling appeals. They can confirm, change, or cancel assessment orders and penalties. They can also decide other matters arising from the original proceedings. A key rule is that they cannot increase an assessment or penalty, or reduce a refund, unless the person appealing had a fair chance to argue against it.
- For assessment appeals, the officer may confirm, reduce, enhance, or annul the assessment.
- If a Settlement Commission proceeding abates under section 245HA, the officer considers all material produced there and can confirm, reduce, enhance, or annul the assessment.
- For penalty appeals, the officer may confirm, cancel, or vary the order to enhance or reduce the penalty.
- In other cases, the officer may pass any orders they think fit.
- The officer cannot enhance an assessment or penalty, or reduce a refund, unless the appellant had a reasonable opportunity to show cause against it.
- The officer may decide any matter arising from the original proceedings, even if the appellant did not raise it before the Commissioner (Appeals).
Example: If an appeal is filed against a penalty, the Commissioner (Appeals) can cancel it or lower the amount. However, if they want to raise the penalty, they must first give the appellant a reasonable chance to explain why the increase is wrong.
