Income-tax Act, 1961 · Chapter XII: B · Special provisions relating to certain companies
Section 115J: Special provisions relating to certain companies
The Income-tax Act, 1961 was repealed by the Income-tax Act, 2025 from 1 April 2026. The text is kept here because the judgments below apply it.
In plain words
This section introduced a minimum tax on companies for assessment years beginning on or after 1st April, 1988 and before 1st April, 1991. If a company's taxable income was less than thirty per cent of its book profit, thirty per cent of book profit was treated as its total income.
- Book profit started from the net profit in the profit and loss account prepared under the Companies Act, 1956.
- It was then increased by items such as income tax, amounts carried to reserves, provisions for unascertained liabilities and dividends.
- Companies generating or distributing electricity were excluded.
- Later sections introduced similar minimum tax schemes.
