Judgment
GURVINDER SINGH GILL, J
. (Oral)
¶1The petitioner seeks grant of regular bail in respect of a case registered against her vide FIR No.50 dated 16.03.2021, registered at Police Station Shahzadpur, District Ambala, under Sections 201, 302, 120-B, 34 of IPC, 1860 and Section 3 of SC/ST Act, 1989 (added later on).
¶2The FIR in question was lodged at the instance of Ashok Kumar, wherein it is alleged that his son Anil Kumar went missing on
14.03.2021 and later his dead body was found in forest on
16.03.2021. The complainant alleged that about two years back, members of the family of Sajjan Singh had given beatings to his son Anil Kumar and now they had come to know that Anil Kumar was chatting with Aman Devi on WhatsApp, who is also related to Sajjan Singh and others. The complainant thus suspected that his son had been murdered by son of Pale, Rinku, Manish Kumar, Shanky, Gaurav and Chandu.
¶3It is the case of prosecution that during the course of interrogation, petitioner Aman Devi was arrested on 18.3.2021 and who suffered a disclosure statement admitting that deceased had been killed by co-accused in connivance with her.
¶4Learned counsel for the petitioner has submitted that she has falsely been implicated in the present case and that there is no evidence worth credence to show that the petitioner had participated in the commission of murder of the deceased.
¶5Opposing the petition, learned State counsel has submitted that in the present case, petitioner-Aman Devi, in her disclosure statement had admitted her guilt of having conspired and connived with co-accused for the purpose of commission of murder of Anil Kumar and that as such, her complicity is clearly evident. Learned State counsel has informed that the petitioner has been behind bars since the last about 1 year and 11 months and that 4 out of cited 24 PWs have been examined and that the complainant is yet to be examined. It is further been informed that the mobile phone of the petitioner had been recovered and that upon examination of the same, it is evident that the petitioner had been in touch with co-accused as well as the deceased. It has however, been informed that the petitioner otherwise is not involved in any other case.
¶6This Court has considered rival submissions.
¶7Admittedly, it is a case based totally on circumstantial evidence. The evidence against the petitioner is mainly in the shape of her own disclosure statement which is annexed as Annexure P-2. Since the said disclosure statement discloses the entire case of the prosecution and the case of the prosecution is mainly based upon the same, it is apposite to refer to the same in detail. The said disclosure statement dated 18.03.2021 (Annexure P-2) is as follows: "In the presence of following witnesses arrested accused Aman Devi in police custody without any fear depose that I am resident of above mentioned address and she has studied till 12th Class. Another boy ride Himanshu's motor cycle and followed them and I went to my home. After some time I got received Anil Kumar message that they have killed Anil Kumar.................................................................................."
¶8A perusal of the aforesaid statement indeed shows that the petitioner had admitted her connivance. However, even as per the said statement, it is not the petitioner who has herself physically participated in the murder of the deceased and she is not alleged to have inflicted any injury. The petitioner otherwise has been behind bars for a substantial period of 1 year and 11 months. Conclusion of trial is likely to consume time inasmuch as only 4 out of cited 24 PWs have been examined. Having regard to the aforestated facts and circumstances and while bearing in mind that the petitioner is a lady and had herself not inflicted any injury to the deceased and she is not even stated to be present at the time of occurrence, the petition is accepted and the petitioner is ordered to be released on bail subject to her furnishing bail bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
