¶3Learned   counsel   appearing   on   behalf   of   Himanshu   Sharma (petitioner in CRM-M-38580-2024) vehemently argued that the petitioner was neither having any acquaintance with the deceased or injured nor with any of the co-accused.  He further contends that even the petitioner was not named in the FIR and had no concern with the allegations levelled by the complainant in the FIR. He further contends that the petitioner has been wrongly involved in the present case only on the basis of the disclosure statement suffered by his co-accused. After completion of the investigation, the final report under Section 173 Cr.P.C. has been presented against the petitioner and his co-accused on

26.05.2023. After that, charge was framed against the petitioner and other co-accused on 04.10.2023. He further contends that the petitioner has been falsely involved in the present case only on the basis of an alleged CCTV footage and the same is yet to be proved during the course of trial. He further submits that in the present case, trial is at the initial stage and is not likely to be concluded in near future. Apart from that, Tej Pal @ Annu has been granted the concession of bail by this Court vide order dated 31.07.2024 (Annexure P-4) and the case of the petitioner is on better footing. Learned counsel appearing on behalf of Sagar @ Kaku (petitioner in CRM-M-39925-2024) also made similar arguments and submitted that the petitioner was arrested in the present case on

10.03.2023 and is in custody since then. Even he was not named in the FIR and CRM-M-38580-2024 an2 connecte2 :atte/% -5 his name had surfaced only during the course of the disclosure statement made by the co-accused. Even as per the alleged CCTV footage, the petitioner could be seen empty handed and had withdrawn from the place of occurrence, as soon as the other co-accused started beating the injured in the present case.  Learned counsel   appearing   on   behalf   of   Nirmal   Sharma   (petitioner   in   CRM-M-43268-2024) vehemently argued that the petitioner was arrested in the present case on 09.03.2023. He is a young boy aged about 27 years and had no criminal antecedents. He was working in the sanitary shop of his cousin and the place of occurrence was also near to the shop of his cousin. When fight started, the petitioner also came out and had witnessed the occurrence. Further, similarly placed co-accused Tej Pal @ Annu has been granted the concession of bail by this   Court.   Similarly,   learned   counsel   appearing   on   behalf   of   Sachin (petitioner in CRM-M-49674-2024) also argued that the petitioner is in custody since 11.03.2023. He is a young boy aged about 24 years and had no criminal antecedents. He was neither named in the FIR nor there is no any averment in the FIR, which even remotely connects the petitioner with the present crime. Apart from that, the petitioner is a first offender and deserves the concession of bail by this Court.

¶4On the other hand, learned State counsel assisted by learned counsel for the complainant have vehemently opposed the submissions made by learned counsel for the petitioners on the ground that the serious allegations have been levelled against the petitioners and they had present at the place of occurrence. However, admittedly, the petitioners have not caused any injuries to the deceased.

¶5 I have heard the learned counsel for the parties and perused the CRM-M-38580-2024 an2 connecte2 :atte/% -6 record.

¶6It is an admitted fact that the petitioners were not initially named in the FIR and during the course of investigation, a CCTV footage was recovered by the police and the petitioners are also shown to be present at the place of occurrence. Apart from that, similarly placed co-accused Tej Pal @ Annu has already been granted the concession of bail by this Court. The petitioners are in custody since sufficiently long time and no purpose will be served by sending them behind the bars.

¶7Without commenting on the merits of the case, the present petition is allowed. The petitioners are ordered to be released on bail pending trial on their furnishing bail bonds and surety to the satisfaction of the concerned trial Court/ Duty Magistrate/Chief Judicial Magistrate subject to the following conditions:-

(i) The petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade them to disclose such facts to the Court or to any other authority.
