The Correspondent v. The State of Tamil Nadu

ORDER The present writ petition has been filed by the Correspondent of an Aided Minority School seeking a mandamus to direct the authorities to approve the promotion of the Secondary Grade Teacher to B.T.Assistant (Tamil) Teacher.

¶2According to the petitioner's Management, one S.P.Louis Rajan, who was working as a Secondary Grade Teacher was promoted as B.T.Assistant (Tamil) on 01.06.2018. The proposal submitted by the Management was originally returned by the authorities citing G.O.(Ms).No.165, School Education Department, dated 17.09.2019. However, the School with a clarification, have re-submitted the proposal to the fourth respondent herein on 06.09.2021. So far, the authority has not passed any orders. Hence, the present writ petition.

¶3Heard the learned counsel appearing for the petitioner and the leanred Government Advocate appearing for the respondents.

¶4Considering the above said facts, the fourth respondent herein is directed to consider the approval of the promotion of one S.P.Louis Rajan, as B.T.Assistant (Tamil) Teacher with effect from 01.06.2018, if the appointment is within the sanctioned strength of the academic year 2018-2019, with all attendant benefits and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

¶5With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
