Judgment

ORDER (Order of the Court was made by S.S.SUNDAR, J.) Alleging willful disobedience of the orders of this Court made in W.P(MD)No.22697 of 2021, dated 23.06.2022, the petitioner has filed this contempt petition.

¶2Earlier, the petitioner has filed a writ petition in W.P(MD)No.22697 of 2021, seeking for issuance of a Writ of Mandamus, directing the respondents therein to construct sufficient toilets around the Chithirai Veethi of Arulmigu Meenakshi Sundareswarar Temple, Madurai, within a stipulated time.

¶3The said writ petition was closed by this Court, vide order dated 23.06.2022, by recording the submission made by the learned Standing Counsel for the Corporation that the construction work is in progress and that, within two months time, the construction would be completed. Alleging willful disobedience of the said order, the petitioner has filed this contempt petition.

¶4When the contempt petition is taken up for hearing today the learned Standing Counsel appearing for the Corporation has stated that they have installed two e-toilets in East Chithirai Street. It is the representation of the learned standing counsel appearing for the Corporation that the local body has undertook only to construct two toilets which are now available in the East Chithirai Veethi.

¶5Since the undertaking given before this Court earlier is complied with and cleaning of toilets as undertaken before this Court is also not disputed, this Court is unable to find any willful disobedience of the orders passed by this Court in the writ petition. Hence, this Contempt Petition is closed. However, the temple authorities as well as the local body shall coordinate for maintaining sufficient number of toilets and ensure proper maintenance of toilets to the convenience of public.
