Vasuki Senthamarai R v. The District Collector

ORDER The writ petition has been filed in the nature of a mandamus seeking a direction to respondents, particularly the 3 and 4 respondents / Tahsildar, Madurai North Taluk and Taluk Surveyor of the said Taluk Office, to survey the land in Survey No.70/4 at Kosakulam Village, Madurai North Taluk. The petitioner had paid necessary fees on 09.02.2023.

2.In the affidavit filed in support of the writ petition, the petitioner claims that she had been residing in the aforementioned property for the past 23 years. It is not specifically mentioned as to how she came into possession of the said property. But however, she had managed to build a house and now she wants to build a taller building in the said place by renovating it. But unfortunately the land was originally classified as Government poromboke, later re-classified as Natham and then assigned to the petitioner herein.

¶3The petitioner cannot claim any title over the property. But the possession itself is now questionable and can be questioned by the respondents. I am at a loss to understand why the writ petition was filed. There is no obligation on the part of the respondents to survey Government land or Natham land. The writ petition stands dismissed. Respondents are permitted to take action, if required, in the manner known to law. No costs.
