¶2The petitioners were the plaintiffs before the District Munsif Court, Oddanchathiram. In the suit, the petitioners had claimed certain declaratory relief and for certain other incidental reliefs. The respondents/defendants had also filed a counter claim. The suit was partly decreed and partly dismissed. To the extent part of the suit was decreed in favour of the petitioners, the respondents filed A.S.No.76 of 2022 before the Sub Court, Oddanchatram.
¶3To the extent part of the counter claim was rejected, the respondents also filed A.S.No.75 of 2022 before the Sub Court, Oddanchatram.
¶4In A.S.No.76 of 2022, the respondents have has filed I.A.No.27 of 2023 under Order XXVI Rule 9 of C.P.C for appointment of an Advocate Commissioner.
¶5The learned counsel for the petitioners submits that the order appointing an Advocate Commissioner to inspect the property and to give a report cannot be countenanced as the relief in O.S.No.29 of 2014 was confined for a declaration. It is submitted that the Court has concluded that the respondents have no right over the 50 cents of land in S.No.90/10.
¶6The learned counsel for the first respondent on the other hand submits that pursuant to the order passed by the Court appointing an Advocate Commissioner, the Advocate Commissioner visited the property and has also given a report. It is submitted that by appointing an Advocate Commissioner who visited the property and note down the physical features of the property and give a report, the Court has not decided one way or the other.
¶7I have considered the arguments advanced by the learned counsel for the petitioner and the learned counsel for the first respondent.
¶8I have also perused the impugned order passed by the learned Subordinate Judge, Oddanchathiram in I.A.No.27 of 2023 in A.S.No.76 of 2022.
¶9By appointing an Advocate Commissioner, the Court has not determined the inter-se rights of the parties one way or the other. The respondents have claimed rights over the land in the schedule to the counter claim, which has been partly allowed and partly rejected. It is the case of the respondents that there is a water course and a pathway. Therefore, to determine the issue, an Advocate Commissioner has been appointed.
¶10There is no merit in the challenge to the impugned order. The present Civil Revision Petition is therefore liable to be dismissed and accordingly, it stands dismissed. The Subordinate Court, Oddanchathiram shall endeavour to dispose of the appeal in A.S.Nos.75 and 76 of 2022 as expeditiously as possible. However, before disposing the appeals, the petitioners shall be given an opportunity to file their objections to the report of the Advocate Commissioner. No costs. Consequently, connected miscellaneous petition is closed.
