ORDER The present Civil Revision Petition has been filed against the fair and decreetal order passed in I.A.No.381 of 2021 in O.S.No.281 of 2020 dated 20.03.2023 on the file of the learned Principal Subordinate Judge, Kumbakonam.

¶2The petitioner is the sixth defendant in O.S.No.281 of 2020 before the Principal Sub Court, Kumbakonam. The said suit was filed by the respondent herein challenging the sale in favour of the petitioner herein by his vendor, who appears to be a subsequent purchaser of the property. In the suit, the petitioner filed I.A.No.381 of 2021 under Order VII Rule 11 of C.P.C., for rejecting the plaint. ¶3The learned counsel for the petitioner submitted that the land originally belonged to one V.K.Abdul Kadhar, who settled the property in favour of his two sons with a condition that they shall have life interest over the property and thereafter, the property shall vest with their legal heirs/progenies. According to the petitioner, this condition is contrary to Section 10 of Transfer of Property Act, 1972. Therefore, he further submits that the Principal Sub Court, Kumbakonam has committed an error in rejecting the application filed by the petitioner for rejecting the plaint.

¶4I do not find any reasons in the present Civil Revision Petition filed by the petitioner. The only ground on which the petitioner can seek for rejection of the plaint is that the ground specified in Order 7 Rule 11 of C.P.C. The objection of the petitioner is that the settlement in the year 1962 was hit by Section 10 of Transfer of Property Act. That is a matter to be decided only by the Trial Court at the time of final hearing. A validly instituted suit cannot be short circuited by filing such an application for rejecting the plaint.

¶5In view of the above observations, the present Civil Revision Petition is liable to be dismissed and accordingly, it stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
