ORDER The present Civil Revision petition has been filed against the fair and decreetal order, dated 17.11.2022 passed in I.A.No.239 of 2022 in O.S.No.127 of 2020 on the file of the District Munsif cum Judicial Magistrate Court, Thiruvidaimaruthur.
¶2The petitioners are the plaintiffs in O.S.No.127 of 2020 on the file of the District Munsif cum Judicial Magistrate Court, Thiruvidaimaruthur. In the above suit, the petitioners had filed an application in I.A.No.239 of 2022 under Order 26 Rule 9 of C.P.C read with Section 151 of C.P.C. The said application has been rejected by the District Munsif cum Judicial Magistrate Court, Thiruvidaimaruthur on the ground that the petitioners are attempting to collect evidence. The relevant portion of the impugned order reads as under: "10. jhth nrhj;Jf;fspd; vy;iyfs; kw;Wk; msTfs; Fwpj;J gpur;rid ,Ug;gjhf $wg;glhj epiyapy; jhthr; nrhj;Jf;fspy; thjpfspd; mDgtk; kw;Wk;

¶3It is the specific case of the petitioners that the respondent in the counter in I.A.No.239 of 2022 has stated that therein joint possession of the property and that there is a joint patta. The relevant portion of the counter of the respondent/defendant reads as under: "cz;ikapy; 4 mapl;l nrhj;Jf;fspYNk mjhtJ vy;yh gl;lhfspYk; gpujpthjpapd; ngah; (Nfhkjp) Nrh;e;Nj cs;s $l;L gl;lh MFk;. kw;Wk; gl;lhtpy; gy ngah;fs; cs;sd. cz;ikia kiwj;jJ kl;Lkpd;wp ngha;ahfNt jdpg;gl;lhthf Fwpg;gpl;Ls;shh;."
¶4A reading of the impugned order and the counter filed by the respondent indicate that the attempt of the petitioners is indeed attempting to collect evidence. If the petitioners wants to establish that the petitioners have a case for permanent injunction, it is for the petitioners to let in evidence to establish their rights. The petitioners cannot expect the Court to come to rescue by appointing an Advocate Commissioner to collect evidence. Therefore, there is no merit in the present Civil Revision Petition.
¶5The present Civil Revision Petition stands dismissed with the above observations. No costs. Consequently, connected miscellaneous petition is closed.
