Judgment
O R D E R The Writ Petition has been filed in the nature of Mandamus, directing the respondents to remove the electric pole which had been installed in Survey No.206/2D belonging to the petitioner and transfer the electricity connection through an alternative route.
2.The petitioner also has coconut trees in a grove and apprehends that if the line is drawn the coconut trees would be damaged or destroyed. In this regard, a report was sought from the respondent and a rough sketch had been produced by the learned Standing Counsel on behalf of respondents who stated that the two electric poles had not been put up within the patta land of the petitioner. They are situated in the boundary line between the Government poramboke land in S.No.206/1 and the land of one Selvam in S.No.206/2D. It is also stated that about six connections can be serviced through these two electric poles.
3.Mr.Khari Kharadass, who appears on behalf of the petitioner has stated he has no serious objection for servicing the line, but stated that the respondents should ensure that the coconut trees should not get damaged. I very much appreciats the statement made by the learned counsel for the petitioner. He has taken a very reasonable stand. This is a very reasonable expectation. The electric line would damage the coconut trees if the leaves fall on the line. The respondents must ensure that the leaves of the trees should never be cut.
4.In view of above statement given by the petitioner, though the relief is not granted to the petitioner, with the above directions this writ petition stands disposed of. No costs.
