Judgment

O R D E R The present transfer civil miscellaneous petition has been filed to transfer O.S.No.154 of 2022 from the District Munsif Court, Manapparai to some other Court in the neighbouring Districts.

2.The petitioner has filed O.S.No.154 of 2022 before the learned District Munsif, Manapparai. The said suit filed by the petitioner against the respondent to declare the 'Tahlaaq' and thus it was pronounced in regular intervals and was valid to dissolve to marriage solemnized between the petitioner and the respondent. The respondent on other hand has filed I.D.O.P.No.119 of 2023 which is said to be pending before the Principal District Court, Trichy. I.D.O.P.No.119 of 2023 is said to be filed for the following relief:- "m)Nkw;gb tof;fpw;F Njitahd ePjpkd;w fl;lzq;fis nrYj;j ,ayhjij kd;dpj;J kDjhuu;fspd; tof;if twpatu; tof;fhf Nfhg;gpw;F vLj;Jk; kDjhuu;fis twpatu;fshf mwptpj;Jk; M)Nkw;gb tof;F 1k; gpujpthjp 1k; thjpf;F mDg;gpajhf $Wk; 11.01.2019k; Njjpapl;l Kjy; jyhf; mwptpg;G rl;lg;gb nry;yj;jf;fjy;y> ,y;yhepiyaJ mJ 1k; thjpia ve;j tifapYk; fl;Lg;gLj;jhJ vd tpsk;Gif nra;Jk;. ,)Nkw;gb tof;F 1k; gpujpthjp 1k; thjpf;F mDg;gpajhf $Wk; 20.02.2019k; Njjpapl;l 2k; jyhf; rl;lg;gb nry;yj;jf;fjy;y> ,y;yhepiyaJ mJ 1k; thjpia ve;j tifapYk; fl;Lg;gLj;jhJ vd tpsk;Gif nra;Jk;. <)Nkw;gb tof;F 1k; gpujpthjp 1k; thjpf;F mDg;gpajhf $Wk; 21.03.2019k; Njjpapl;l 3k; jyhf; rl;lg;gb nry;yj;jf;fjy;y> ,y;yhepiyaJ mJ 1k; thjpia ve;j tifapYk; fl;Lg;gLj;jhJ vd tpsk;Gif nra;Jk;. c)Nkw;gb tof;F 1k; gpujpthjp 1k; thjpf;F khjk; &. 40>000-tPjKk; 2k; thjpf;F &.30>000-tPjKk; tho;f;if nghUSjtpahf jhth Njjp Kjy; toq;f cj;jutpl;Lk; mjid njhlu;e;J jhth njhiffSf;fhf jhth nrhj;jpd; Ngupy; rhu;[; gupfhuk; toq;fpAk;. 3.The learned counsel for the respondent opposes the transfer petition.

4.I have considered the arguments advanced by the learned counsel for the petitioner and the respondent.

5.There are police complaints that are pending against the family members of the petitioner and the respondent. The respondent herself has filed I.D.O.P.No. 119 of 2023 before the learned Principal District Judge, Trichy. One of the issues in I.D.O.P.No.119 of 2023 is an issue in O.S.No.154 of 2022 filed by the petitioner before the District Munsif Court, Manapparai.

6.Considering the above, I am inclined to dispose the transfer civil revision petition by ordering transfer of O.S.No.154 of 2022 from the District Munsif Court, Manapparai, to the Principal District Court, Trichy to be tried along with I.D.O.P.No.119 of 2023. The learned Principal District Judge, Trichy shall endeavour to dispose both the proceedings within a period of 12 months from the date of receipt of a copy of this order.

7.With the above observation, this Transfer Miscellaneous Petition is allowed. No costs. Consequently, the connected miscellaneous petition is closed.
