Judgment
ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 3rd respondent to receive, entertain, and register the settlement deed dated 03.06.2026 executed by the petitioner in favour of her daughter, Ms.Arulmary.
¶2The case of the petitioner is that she is the absolute owner of the subject property measuring 1.27 acres in Old Survey No. 65/2B, presently Survey No. 65/2D, situated at Narumanam Village, Virudhachalam Taluk, Cuddalore District. The property was settled in her favour by her husband, Page2 of 5 S.Vanathaiyan, through a registered Settlement Deed dated 16.12.2010 (Document No. 6103 of 2010), and Patta No. 1017 was subsequently issued in her name. The petitioner has been in continuous and peaceful possession and enjoyment of the property. On 03.06.2026, she presented a Settlement Deed for registration before the 3rd respondent; however, the document was orally refused registration without any written refusal order or reasons, solely on the ground that the parent document mentions Old Survey No. 65/2B, whereas the present revenue records reflect Survey No. 65/2D. Aggrieved by the same, the petitioner is before this Court seeking appropriate relief.
¶3The learned Government Counsel appearing for the respondents submitted that there is a discrepancy in the survey number of the parent document, showing no correlation between the parent document and the proposed Settlement Deed. He further submitted that if the Settlement Deed dated 03.06.2026 is otherwise in order, the respondents would take a decision thereon in accordance with law.
¶4In such circumstances, this Court is of the view that if the Settlement Deed is in accordance with law, the same ought to be registered by the registering authority. Accordingly, the Sub Registrar concerned is directed to Page3 of 5 register the Settlement Deed dated 03.06.2026 if the same is otherwise in order, within a period of one (1) week from the date of receipt of a copy of this order.
¶5With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. 02-07-2026 Asi To
