ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondent to consider and dispose of the petitioner's representation dated 13.05.2026 within a reasonable period as may be fixed by this Court and further direct the respondent to measure the property, fix the boundaries with stones for proper identification, demarcate the boundaries, furnish all the relevant revenue records pertaining to the property.
¶2When the matter was taken up for hearing today, the learned counsel appearing for the petitioner submitted that although a larger relief was initially sought, the petitioner would now restrict the prayer. Specifically, the petitioner seeks a direction to the respondent to survey his land and lay boundary stones within a time frame fixed by this Court. The subject property is located at Plot Nos. 71 and 72, Patchai Vazhi Amman Nagar, Kottukuppam Village, Vanur Taluk, Villupuram District. It comprises Old Survey No. 303/2, New Survey Page2 of 5 Nos. 278/2A, 278/3A, and 278/30, and is covered under Patta No. 7650. The petitioner purchased the said property through a registered Sale Deed bearing Document No. 3211 of 2003, dated 03.11.2003.
¶3Heard the learned counsel appearing for the petitioner and the Government Counsel appearing for the respondent.
¶4In view of the submission made by the learned counsel for the petitioner restricting the prayer to a survey and the laying of boundary stones, this Court, without going into the merits of the case, directs the respondent to conduct a survey of the subject property comprised in Old Survey No. 303/2, New Survey Nos. 278/2A, 278/3A, and 278/30, covered under Patta No. 7650, situated at Plot Nos. 71 and 72, Patchai Vazhi Amman Nagar, Kottukuppam Village, Vanur Taluk, Villupuram District, and fix boundary stones within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be Page3 of 5 effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party.
