Judgment

ORDER Date : 20.11.2024 Heard Mr. J. Tsering, learned counsel for the applicant. Also heard Mr. G. Tado, learned Additional Public Prosecutor for the State. This is an application filed under Section 5 of the Limitation Act, 1963, praying for condonation of delay of 25 days in filing the connected criminal appeal against the judgment and sentence order dated 27.08.2024, passed by the Special Judge, NDPS, Bomdila in NDPS Case No.13/2023 in connection with Page No.# 2/2 Kalaktang P.S. Case No.11/2021. Having considered the grounds taken in the application for condonation of delay in filing the connected criminal appeal and the prayer not being opposed to by the learned Additional Public Prosecutor, I am satisfied that the applicant has shown a sufficient cause which prevented him to file the connected appeal within a period of limitation. Accordingly, the delay of 25 days in filing the connected appeal is condoned. The interlocutory application(criminal) stands allowed and disposed of. JUDGE Comparing Assistant
