Judgment

ORDER Date : 08-11-2024 Heard Ms. T. Rimi, learned counsel for the petitioner. Also heard Mr. T. Tagum, learned Standing counsel for the Education Department, representing all the respondents.

¶2This is an application under Section 226 of the Constitution of India, praying for a direction to the respondent authorities to consider the representation submitted by the petitioner on 03.10.2024 to the Director of Secondary Education and also the representation dated 07.10.2024, submitted to the President, Arunachal Teachers Association, praying for implementation of the petitioner's transfer order by releasing her from the present place of posting.

¶3It is submitted by Ms. Rimi, learned counsel for the petitioner that, despite submitting representations to the concerned authority, the petitioner's release order has not been issued, preventing her from joining her new place of posting. Consequently, the present writ petition has been filed, seeking a direction to the respondent authorities, more particularly the respondent No. 3, i.e., the Deputy Director of School Education, Seppa, East Kameng District, Arunachal Pradesh, to issue the release order of the petitioner and to forward her Service-book in her new place of posting.

¶4Mr. Tagum, learned Standing counsel representing the respondent authorities, submits in this regard, that he has received instructions that the Page No.# 3/3 process for issuing the release order of the petitioner has already been initiated and the administrative approval from the concerned authority will be obtained soon and the entire process for issuance of the release order as well as forwarding Service-book etc. of the petitioner will be completed within 2 (two) weeks.

¶5Considering the submissions made by the learned counsels for both the sides and the initiative taken by the respondent authorities, the present writ petition is disposed of, in the motion stage itself, with a direction to the respondent authorities, more particularly the respondent No. 3, i.e., the Deputy Director of School Education, Seppa, East Kameng District, to issue the release order of the petitioner, after getting the administrative approval from the authority concerned and also, to forward the Service-book of the petitioner to her new place of posting.

¶6The writ petition stands disposed of, in terms above.
