Judgment
ORDER Date : 25-10-2024 Heard Mr. N. Rama, learned counsel for the petitioner, along with Mr. R. Nabam, learned Standing counsel for the Rajiv Gandhi University (RGU), representing the respondent Nos. 1 to 3.
¶2The instant writ petition is filed challenging the Rajiv Gandhi University Students Union (RGUSU) Election, 2024-25, which was held as per the notification dated 13.09.2024.
¶3The case of the petitioner is that during the election, Clause 6.3.1 of the Lyngdoh Committee Reports and Guideline, which was accepted by the Hon'ble Supreme Court for implementation, was violated since there was interference by 3 (three) persons, who are not the bonafide students of the said institutions. The petitioner had then filed complaints for the said violation of Clause 6.3.1 of the Lyngdoh Committee Reports and Guideline and finally a Grievance Redressal Committee of the RGUSU Election, 2024, was constituted. As per the Enquiry Report, Conclusion and decision of the Grievance Redressal Committee, it was found that the complaint seeking the revocation of the candidature of the respondent No. 4 is liable to be dismissed.
¶4Aggrieved by the findings of the said Grievance Redressal Committee, Page No.# 3/3 which, according to the petitioner, was not done as per Clause 6.8.12 of the Lyngdoh Committee Reports and Guideline, the petitioner had filed an appeal before the appellate authority, which is the Registrar, Rajiv Gandhi University, Rono Hill, Doimukh on 04.10.2024 within 24 hours of the decision of the Grievance Redressal Committee of the RGUSU Election, 2024. However, the appellate authority, till date has not considered the grievances/appeal filed by the petitioner and hence, the instant writ petition.
¶5Mr. R. Nabam, learned Standing counsel, RGU appearing on behalf of the respondent university accepts notice on behalf of the respondent Nos. 1 to 3 and submits that the Appellate Authority is yet to consider and dispose of the appeal.
¶6Having heard the submissions made by the learned counsels and on considering the limited prayer made by the petitioner, which is for the appeal pending before the Appellate Authority be disposed of expeditiously as per the Clause 6.8.12 of the Lyngdoh Committee Reports and Guideline, this Court finds it fit to dispose of the instant writ petition with a direction to the appellate authority, impleaded as respondent No. 2, i.e. the Registrar, Rajiv Gandhi University, Rono Hill, Doimukh to dispose of the appeal applicant, dated
04.10.2024, made by the petitioner, expeditiously, within a period of 2 (two) weeks from the date of receipt of the certified copy of this order.
¶7Accordingly, the writ petition stands disposed of with the above direction. JUDGE Comparing Assistant
