ORDER
25.11.2024 Heard Mr. L.H. Lianhrima, learned senior counsel, assisted by Ms. Ruth Lalruatfeli for the appellant. Also heard Mr. Johny L Tochhawng, learned counsel for the respondent. Both the learned counsels submit that the parties have come to an amicable settlement outside of Court and have submitted the "DEEDS OF AGREEMENT" duly signed by the Petitioner No. 2 and the Respondent No. 1 in the presence of 2 (two) witnesses, along with an attached diagram indicating the conditions of the terms of agreement by highlighting the disputed landed property in shades of purple and light greenish-yellow color. The terms of "DEEDS OF AGREEMENT" dated 28.09.2024 simply stated that the parties have come to an amicable settlement in terms of the sketch map attached herein. The learned counsels for both the parties submit that all the Petitioners being 3(three) in numbers and the Respondents being 13 (thirteen) numbers have all agreed to the agreement wherein in the diagram of the sketch map, the landed area which is colored in purple color is to belong to the Respondent No. 1, Pu K Thangzuala S/o Lalchhuma (L) and the landed area colored in light greenish yellow color is to belong to the appellant No. 2, Pu Malsawmdawngliana S/o Dr. Lenghaia (L). It is submitted by the learned Page No.# 5/5 counsels that in the instant Regular Second Appeal filed by the appellant may be disposed of in terms of the agreement arrived by the parties. On considering the submissions made by the learned counsels for both the parties, this Court finds it fit that the "DEEDS OF AGREEMENT", which also includes a sketch map of the disputed property should be marked as Ex-1 and be made a part of the file. This Court finds it fit to dispose of the instant Regular Second Appeal on finding that the Appellant No. 2, Pu Malsawmdawngliana and the Respondent No. 1, K Thangzuala have both come to an agreement by dividing the disputed property, wherein the landed property in the sketch marked color light purple is to belong to Respondent No. 1, K Thangzuala and the property shown in color light greenish-yellow color is to belong to Pu Malsawmdawngliana Appellant No. 1. Thus, on the parties having come to an amicable settlement, copy of which is marked as Ex-1, duly witnessed by 2 (two) witnesses namely TC Lalnunhruaii & Zonunmawii on 28.09.2024, the instant Regular Second Appeal No. 11/2029 stands disposed of.
